1. Acceptance of Terms

By accessing or using the Modguard website, Discord bot, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Modguard provides a suite of moderation and community management tools for Discord servers. These services are provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts and Security

You are responsible for maintaining the security of your Discord account and any permissions you grant to the Modguard bot. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

4. Usage & Conduct

You agree NOT to use the Service to:

• Violate any applicable laws, regulations, or Discord's Terms of Service.
• Harass, abuse, or harm another person or group.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the software.
• Use the Service for any malicious purpose, including but not limited to spamming or raiding.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Modguard. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Modguard.

6. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

7. Limitation of Liability

In no event shall Modguard, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
